Philip advises on a wide range of estate planning matters including inheritance tax and capital gains tax. Amongst other things, Philip assists individuals and families and helps to achieve their objectives in terms of asset ownership and protection. A significant part of the advice relates to and involves the setting up, administration and winding up of trusts and associated tax advice. Philip’s expertise extends to aspects of the ownership and taxation of many different types of asset including businesses, landed estates, the family home and contents as well as investments, life assurance and pension arrangements (all from a point of view of mitigating exposure to inheritance tax and/or capital gains tax).

In the 1990s Philip worked as an in-house solicitor for a large city firm of accountants before joining Warners in 1997. He spent 4 years with asb law in Maidstone before returning to Warners.

Experience

  • Inheritance tax planning – putting in place arrangements with a view to saving millions of pounds of tax that would otherwise have been payable when the client died in 2015. This involved setting up complicated (and ongoing) trust arrangements.
  • The family business – helping to rearrange a long established family business with a view to passing assets to the next generation and doing so in a tax efficient manner in line with the differing views and requirements of various family members.
  • Offshore trusts – advising on the tax status of various offshore trusts and possibilities to consider in the lead up to various tax changes that are being introduced in 2017.
  • Contested estates – acting in relation to claims brought under the Inheritance (Provision for Family and Dependants) Act 1975 and doing so in a way that by virtue of the drafting of the Court Order, saved millions of pounds in inheritance tax.
  • Tax investigations – assisting in addressing claims by HMRC for substantial amounts of tax and successfully arranging for such claims (again running into millions of pounds) to be dropped (and even negotiating a contribution from HMRC towards costs).
