Nick is a partner in the dispute resolution and litigation team. He has extensive experience with residential landlord and tenant disputes, particularly acting for landlords in claims for possession of land and housing disrepair, though is also instructed in all landlord and tenant disputes, boundary disputes and trespass matters.

Experience

  • Advising on and pursuing claims for possession of residential property in respect of breach of tenancy or for any other reason
  • Anticipating and responding to defences on the grounds of disability discrimination
  • Overcoming difficulties relating to deposits taken in respect of assured shorthold tenancies
  • Defending claims for housing disrepair, including EPA prosecutions
  • Action to remove trespassers either from buildings or from open land
  • Obtaining injunctions to prohibit trespass on and interference with land
  • Assisting with all aspects of the opposed and unopposed lease renewal process for commercial leases (Landlord and Tenant Act 1954)
  • Advising in respect all issues arising from commercial leases, including break notices, consents and breach of terms
  • Recovery of monies owing and arising out of either residential or commercial landlord and tenant relationships
  • Assisting both landlords and leaseholders with the procedure for extending residential leases under the Leasehold Reform, Housing and Urban Development Act 1993
  • Acting in relation to boundary disputes and claims for adverse possession
  • Advising on, and preparing notices pursuant to,  the right of first refusal under S.5 Landlord and Tenant Act 1987
