Dispute Resolution

Warners has a team of experienced litigators based in our Tonbridge and Sevenoaks offices who are able to advise on all aspects of civil and commercial litigation. We can pursue or defend a claim for compensation and we will discuss the merits of the case with you and advise you on your best course of action using clear and simple language. 

 

We always seek to resolve matters as quickly as possible, helping you through each step of the process and at a minimum cost. We do this by acting promptly on your instruction and sometimes advising you to accept an earlier compromise rather than pursue lengthy and costly proceedings. 

 

Mediation is another way to settle a dispute which is simple and cheaper than other methods.  Warners has been helping people resolve issues through mediation for over 10 years.

 

Our Services

Building and boundary disputes
We are able to advise on building disputes from a poorly constructed house extension to large scale  disputes involving commercial premises.
 

Contractual disputes

We deal with a variety of contractual disputes i.e. sale of goods/services, misrepresentation and the particular problems relating to IT disputes. 

 

Debt collection

We offer advice on proceeding in the County Court/High Court.  We also have particular expertise in the area of insolvency. 

 

Landlord and tenant disputes

We can assist you with possession proceedings both commercial and residential.  All areas of Landlord and Tenant Act 1954.  Repair claims and rent review.

 

Personal injury claims

We can provide legal assistance with matters relating to road traffic accidents, accidents at work and medical accidents.  We are prepared to act on a conditional fees basis in appropriate cases. 

 

Employment disputes

We act for both employers and employees in the Employment Tribunal and the High Court.  We have developed an Employment Law Unit comprising lawyers who have particular expertise in this fast growing area.

 

Matrimonial and family problems

Some examples of recent cases we have acted on:
• Acting for a builder/developer in  pursuing a joint venture and seeking to recover joint profits that had not been distributed fairly. 
• Acting for a client against former solicitors who had failed to advise him properly and recovering a six figure settlement from the professional indemnity insurers for solicitors. 
• Acting for a farmer in dealing with an allegation of water pollution, representing him before the court and achieving a satisfactory result. 
• Obtaining possession of property following a land transaction which did not reflect the parties' mutual intentions.

• Acting for a doctor in a partnership dispute resulting in a division of the medical practice assets after contested proceedings in the High Court.
