There are many ways in which our extensive experience can benefit you:
Impartial advice - we will help you to clarify your own ideas; you may not have thought of all the eventualities for which your Will needs to cater. Perhaps most important of all, we will provide you with unbiased, independent, advice.
Home visits - we are always prepared to make home visits by arrangement.
Lasting Powers of Attorney - Since October 2006 it has been possible, via a Lasting Power of Attorney, to grant to some person or persons whom you can trust (such as a spouse, relative, friend or your solicitor) the right to manage your property and finances should you become incapable of doing so yourself either due to mental incapacity or simply if you are out of the country. You can also now prepare a Lasting Power of Attorney giving a relative or friend the power to make welfare decisions on your behalf (such as whether you need to go into a home and if so which home) in circumstances where you are no longer mentally capable of making such decisions. This document can also give somebody of your choice the legal authority to consent to or refuse treatment on your behalf. For further information please see our leaflet “Lasting Powers of Attorney”.
Trusts - these may be provided for within a Will or during lifetime. Trustees will then administer an estate/trust fund on behalf of a particular beneficiary or a particular group of beneficaries. This can be useful where a beneficiary is either young, elderly or disabled.
Tax planning - making a Will can form a vital part of your tax planning, and can minimise the inheritance tax liability which otherwise falls on beneficiaries. Principally the concern is about inheritance tax. Currently, only the first £300,000 of an estate is exempt from this tax and then the balance is charged at a rate of 40% - although this may be subject to change in some circumstances following the announcement of the 2007 Pre-Budget Report on 9 October. For further information on tax planning please see our leaflets on personal taxation (although please note that these have not been updated since the Pre-Budget Report was announced).
Will storage - Warners are prepared to retain the original of your Will in safekeeping without charge, supplying you with a copy for your records.
Costs - the majority of Wills are fairly straightforward, and it is therefore not expensive to have one drawn up. We will be happy to quote a fee without obligation. The costs are small when weighed against the peace of mind gained.
